1. Introduction and Contractual Relationship
These Terms of Service constitute a legally binding agreement between you (“User,” “Customer,” “your”) and HajjUmrahTaxi.co.uk (“the Company,” “we,” “us”). These terms govern the use of our digital platform to facilitate the booking of transportation services within the Kingdom of Saudi Arabia for pilgrims, tourists, and business travelers.
2. Definitions
- “The Company”: Refers to HajjUmrahTaxi.co.uk, acting exclusively as a booking intermediary.
- “Service Provider”: The independent Driver or Partner Fleet licensed in Saudi Arabia who fulfills the transportation.
- “Booking Contract”: The agreement between the User and the Company for the provision of booking services.
- “Transport Contract”: The agreement for physical carriage between the User and the Service Provider.
3. Agency Disclosure & Limitation of Liability
3.1 Status of the Company: You explicitly acknowledge that HajjUmrahTaxi.co.uk operates as a Disclosed Agent. We facilitate the contract between you and the Service Provider. We do not own, operate, or control the vehicles used for the service.
3.2 The Service Contract: When you book via our platform, you enter into two contracts: (a) A contract with us for the booking service (for which we receive a commission), and (b) A contract with the Service Provider for the ride itself. The Service Provider is solely responsible for the performance of the trip.
3.3 Liability: To the maximum extent permitted by law, the Company shall not be liable for any injury, loss, delay, or damage caused by the Service Provider. Any claims regarding the vehicle’s condition or the driver’s conduct must be directed to the Service Provider.
4. Vetting & Partner Compliance
4.1 Due Diligence: We undertake to vet all Service Providers to ensure they hold the compulsory registrations, licenses, and insurance required by the Saudi Arabian Ministry of Transport and other relevant agencies at the time of onboarding.
4.2 Scope of Responsibility: While we perform initial and periodic checks, the Service Provider is responsible for maintaining their legal compliance and insurance validity daily. We act as a facilitator of information provided by these third parties.
5. Pricing, Payments, and Commission
5.1 Dynamic Pricing: Rates fluctuate based on pilgrimage seasons (Ramadan/Hajj), local demand, and car category. Quoted rates are final at the time of checkout for that specific transaction.
5.2 Payment Flow: We collect the total fare on behalf of the Service Provider. Our revenue consists of a commission (typically 10-20%) for the booking service. The remaining balance is held on behalf of and transferred to the Service Provider.
5.3 Currency: Our base currency is GBP. Conversion fees of 0.5% to 3% may apply for other currencies. By booking, you accept our proprietary exchange rates.
6. Cancellation, Refunds, and Service Reviews
6.1 72-Hour Window: A 100% refund is available if cancelled at least 72 hours before pickup. Within 72 hours, the booking is non-refundable as the Service Provider has already allocated the vehicle and lost the opportunity for other bookings.
6.2 Dispute Resolution: While we are not the principal provider, we will mediate disputes. Claims must be filed within 7 days of completion. Refunds are at the Company’s discretion following a review of the Service Provider’s performance.
7. Waiting Time and No-Show Protocol
7.1 Grace Period: A 90-minute grace period applies to airport arrivals from the time of landing. For hotel pickups, the 90-minute period starts from the scheduled time.
7.2 Contact Obligation: Users must be reachable by phone. Failure to meet the driver or communicate within the 90-minute window results in a “No-Show” status. No refunds are issued for No-Shows.
8. Luggage, Capacity, and Safety
8.1 Limits: Each vehicle has a strictly defined luggage capacity. Exceeding this capacity may result in the Service Provider refusing the trip without a refund.
8.2 Roof Storage: For safety and insurance reasons, luggage is strictly prohibited from being secured to the vehicle’s roof. All luggage must be stored inside the vehicle’s designated compartments.
9. Journey Logistics and Deviations
9.1 Scope: The service is point-to-point. Service Providers are not authorized to deviate from the pre-booked route unless additional waypoints were paid for during booking.
9.2 Comfort Stops: Brief stops for prayer or essential needs are at the Service Provider’s discretion. Extended stops for dining or shopping are subject to additional hourly rates.
10. Visa, Pilgrimage, and Traveler Responsibility
10.1 Not a Travel Agency: HajjUmrahTaxi.co.uk is a transport booking platform, not a Hajj/Umrah travel agent. We provide transport only.
10.2 Documentation: It is the sole responsibility of the traveler (Pilgrim, Tourist, or Business Guest) to ensure they possess the valid Visa and permits for their specific destination. We are not liable for delays caused by government checkpoints or missing permits.
11. Passenger Conduct and Vehicle Damage
11.1 Zero Tolerance: Smoking, vandalism, or abuse toward the Service Provider will result in immediate termination of the service without a refund.
11.2 Damages: Users are liable for any damage or professional cleaning costs (e.g., food spills, sickness) caused to the Service Provider’s vehicle. We reserve the right to charge the customer’s card on behalf of the Service Provider for such costs.
12. Force Majeure
The Company and Service Provider shall not be held liable for failures caused by events beyond reasonable control, including but not limited to sandstorms, floods, sudden changes in Ministry of Hajj and Umrah regulations, or mechanical breakdown.
13. Governing Law and Jurisdiction
13.1 Booking Contract: Disputes regarding the booking service provided by HajjUmrahTaxi.co.uk are governed by the Laws of England and Wales.
13.2 Transport Contract: Disputes regarding the physical transportation and conduct of the ride are governed by the Laws of the Kingdom of Saudi Arabia and shall be settled in the courts of Saudi Arabia.
